Terms of Service

These Terms of Service ("Terms") govern your use of the Stone Phone subscription service ("Service") operated by Stone Phone ("we," "us," or "our"). By subscribing to the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not subscribe.
1. The Service
Stone Phone is a subscription service in which we provide you with a pre-configured, locked-down iPhone SE (2nd generation, 64GB, unlocked) for your personal use. The device is shipped to you with certain apps, features, and capabilities intentionally restricted or removed based on the plan you select at signup.
The Service is designed to reduce smartphone addiction by permanently blocking access to social media apps, certain websites, and other attention-trapping features. The restrictions are enforced using mobile device management (MDM) technology and cannot be removed, bypassed, or modified by you.
2. Eligibility
You must be at least 18 years old and reside in the United States to subscribe to the Service. By subscribing, you represent that you meet these requirements.
3. Plans and Pricing
We offer two subscription plans:
- Focus ($29/month): Essentials only. Includes Phone, Messages, FaceTime, Contacts, Camera, Photos, Maps, Spotify, Weather, Clock, Calculator, Calendar, Notes, Wallet, and Settings. Optional utility add-ons (e.g., Uber/Lyft, banking app, WhatsApp, authenticator) may be requested at signup. One change request per month after initial setup. Social media apps are permanently blocked.
- Balance ($49/month): Everything in Focus, plus Safari (with content filtering), Mail, and App Store (restricted). You may customize your app list at signup from approved categories: Productivity, Communication, Finance, Health & Fitness, Travel, and Utilities. One change request per week. Includes a 3-day onboarding period with one change request per day. Social media apps are permanently blocked.
All prices are in US dollars. Pricing may change with 30 days' written notice to you via the email address associated with your Stripe account.
4. Deposit
A refundable deposit of $99 is collected at the time of signup. The deposit is fully refundable upon return of the device in acceptable condition (normal wear and tear permitted). If the device is returned damaged beyond normal use, lost, or not returned, we may retain part or all of the deposit to cover the cost of the device. We will notify you of any deduction before processing.
5. 90-Day Commitment
The Stone Phone program requires a minimum 90-day commitment. Your subscription is billed monthly — you are not prepaying for 90 days. However, you agree not to cancel the Service before the end of your 90-day commitment period. After 90 days, you may cancel at any time with 30 days' notice.
If you cancel before the 90-day period ends, you must return the device within 14 days. Your deposit will be refunded upon return of the device in acceptable condition, but any monthly subscription fees already charged are non-refundable.
6. Device Ownership
The device remains the property of Stone Phone at all times. The Service is a subscription, not a purchase. You are granted a limited, non-transferable, non-sublicensable right to use the device for the duration of your subscription. You may not sell, lease, lend, give away, or otherwise transfer the device to any third party.
7. Device Management (MDM)
The device is enrolled in our mobile device management (MDM) system. By subscribing to the Service, you consent to the following:
- We control which apps can be installed and removed on the device.
- We control which websites can be accessed through Safari (Balance plan only).
- We may push configuration updates, app restrictions, or security patches to the device remotely.
- We can see which apps are installed on the device and whether the device is active.
We cannot and do not access your personal data, including but not limited to: messages, photos, phone calls, browsing history, location data, contacts, email content, or any files stored on the device. See our Privacy Policy for full details.
You may not attempt to remove, disable, circumvent, or interfere with the MDM enrollment or any device restrictions. Doing so constitutes a breach of these Terms and may result in termination of your subscription.
8. Social Media Policy
Social media apps are permanently blocked on all plans, with no exceptions. This includes, but is not limited to: Instagram, TikTok, X (Twitter), Facebook, Snapchat, YouTube, and Reddit. Access to social media websites is also blocked where applicable.
We will not add social media apps to your device under any circumstances, regardless of stated purpose (personal, professional, or otherwise). This is a core feature of the Service, not a limitation. If you require social media access on your phone, the Stone Phone service is not appropriate for you.
9. Change Requests
After initial setup, you may submit change requests to modify your app list according to your plan's limits:
- Focus: One change request per month.
- Balance: One change request per week, plus up to one change request per day during the first 3 days after device delivery (onboarding period).
We reserve the right to deny any change request for an app or service that we determine, in our sole discretion, to be a social media app, an attention-trapping app, or otherwise contrary to the purpose of the Service.
10. SIM Card and Carrier
The device is shipped unlocked and is compatible with any carrier that supports the iPhone SE (2nd generation). You are responsible for providing your own SIM card or eSIM and maintaining your own cellular service plan. We include a SIM card removal tool with the device. We are not affiliated with any mobile carrier and do not provide cellular service.
11. Shipping and Returns
We ship devices within the United States. Delivery times are typically 2-5 business days after your device has been configured. You will receive a shipping confirmation with tracking information via email.
Upon cancellation, you must return the device within 14 days using the prepaid shipping label we provide. If the device is not returned within 14 days of cancellation, we may charge the full replacement cost of the device to the payment method on file, and your deposit will be forfeited.
12. Acceptable Use
You agree to use the device and Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Attempt to remove, bypass, or disable the MDM enrollment or device restrictions.
- Attempt to factory reset, jailbreak, or otherwise modify the device software.
- Use the device for any illegal activity.
- Transfer, sell, or lend the device to any other person.
- Intentionally damage or destroy the device.
13. Billing and Payment
All payments are processed through Stripe. Your subscription will be billed monthly on the anniversary of your signup date. By subscribing, you authorize us to charge your payment method on file for all applicable fees.
If a payment fails, we will attempt to charge your payment method again. If payment remains unsuccessful after 7 days, we may suspend your Service and request the return of the device.
14. Cancellation and Refunds
After your 90-day commitment period, you may cancel your subscription at any time by contacting us. Upon cancellation:
- Your current billing cycle will not be refunded.
- You must return the device within 14 days.
- Your $99 deposit will be refunded once the device is received in acceptable condition.
We reserve the right to terminate your subscription at any time for violation of these Terms. In the event of termination for cause, deposit refund will be determined on a case-by-case basis.
15. Limitation of Liability
To the maximum extent permitted by law, Stone Phone shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service or device, including but not limited to: loss of data, loss of use, or inability to access specific apps or services.
Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to us in the 3 months preceding the claim.
The device is provided "as is" for the purposes of the Service. We do not guarantee uninterrupted access to any specific app or feature, and we reserve the right to modify the available apps and configurations as needed to maintain the integrity of the Service.
16. Disclaimer of Warranties
The Service and device are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
17. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
